tomboyx Rewards Terms & Conditions

These Terms and Conditions ("Program Terms") govern participation in the tomboyx Rewards Program ("Program") operated by tomboyx, Inc. ("tomboyx," "we," "us," or "our"). By creating an account, enrolling in, or otherwise participating in the Program, you ("Member," "you," or "your") agree to be bound by these Program Terms. These Program Terms are incorporated into and supplement our general Terms & Conditions; in the event of a conflict specific to the Program, these Program Terms control.

1. Eligibility

To join the Program, you must:

• Be at least 13 years of age (or have parental/guardian consent if under the age of majority in your jurisdiction)

• Create a tomboyx account and voluntarily opt in to the Program

• Have a valid email address on file

tomboyx reserves the right to verify eligibility, limit enrollment, or deny/revoke Program participation at its sole discretion.

2. How Points Work

2.1 Earning Points Members earn points as follows:

Points are awarded once an order is marked as Paid. tomboyx may add, remove, or change point-earning actions and their point values at any time without prior notice, except as otherwise stated for VIP tier changes below.

2.2 Redeeming Points Points may be redeemed for rewards as made available by tomboyx from time to time in the Program, at a value of 100 points = $5, applied as a gift card at checkout; points cannot be redeemed if the order value is under $5. Points have no cash value and cannot be redeemed for cash, sold, or transferred — there is no points-to-cash conversion option. Points can only be redeemed by the Member who earned them.

2.3 Points Expiration Points expire 365 days after a Member's last account activity. 

2.4 Returns and Cancellations If an order that earned points is returned, cancelled, or refunded, the associated points will be deducted from your account, even if this results in a negative balance that must be offset by future point-earning activity.

3. VIP Tiers

The Program includes two membership tiers, evaluated on a rolling 12-month basis:

If a Luxe Member's trailing 12-month spend falls below the $200 threshold, the Member will be automatically downgraded to Essential tier.

tomboyx may modify tier thresholds, benefits, or add/remove tiers at any time. Material reductions in tier benefits will be communicated to affected Members via email.

4. Referral Program

Members may refer friends to tomboyx. Upon a successful referral:

• The referring Member earns 200 points

• The referred friend receives a coupon for $10 off a $40+ purchase (minimum spend: $30). This discount cannot be combined with other promotions. 

Referral rewards are subject to fraud review. tomboyx reserves the right to withhold or reverse referral rewards obtained through abuse, fake accounts, or self-referral.

5. Program Modifications and Termination

tomboyx reserves the right to modify, suspend, or discontinue the Program (or any part of it, including point values, tiers, and rewards) at any time, with or without notice, except where notice is required by law. If the Program is discontinued, tomboyx will provide Members a reasonable opportunity to redeem accumulated points before termination, unless prohibited by fraud, abuse, or violation of these Program Terms.

tomboyx may suspend or terminate a Member's Program participation, and forfeit accumulated points, for violation of these Program Terms, fraudulent activity, or abuse of the Program (including use of bots or fake accounts to generate points or referrals).

You may withdraw from the Program at any time by contacting help@tomboyx.com. Withdrawal forfeits any unredeemed points.

6. No Warranty; Limitation of Liability

The Program is provided "as is." tomboyx does not guarantee the availability of any specific reward. To the fullest extent permitted by law, tomboyx is not liable for any indirect, incidental, or consequential damages arising from your participation in the Program, and tomboyx's total liability to you under these Program Terms shall not exceed the redemption value (per Section 2.2) of your unredeemed points at the time of the claim.

7. General

These Program Terms are governed by the laws of the State of Washington. All other terms not addressed here (including dispute resolution, arbitration, and general legal provisions) are governed by our Terms & Conditions. Void where prohibited by law.
